论网约车司机劳动关系的认定——以从属性标准的突破为视角
On the Identification of the Labor Relationship of Online Car-Hailing Drivers—From the Perspective of the Breakthrough of the Subordination Standard
摘要: 根据传统的劳动关系认定标准,即从属性标准,对不同运营模式下出租车司机的劳动用工关系进行分析,相比传统巡游出租车司机,网约车司机与平台之间更难认定劳动关系,因此网约车司机的劳动权益保障是现下亟待解决的问题。从属性标准具有较强的弹性,仍能包容新业态下的用工关系,但要解决网约车司机的劳动权益保障问题,则需要在传统认定标准上进行适当突破。在多种突破方式中“克减劳动关系”实为较优选,而劳动“三分法”将此方式落地。目前我国应积极填补网约车行业劳动基准制度的空白,制定行业通用协议范本,加快落实对网约车司机劳动权益的保障。
Abstract: According to the traditional labor relationship identification standard, that is, the subordination standard, the labor-employment relationship of taxi drivers under different operation modes is an-alyzed. The protection of labor rights and interests of online car-hailing drivers is an urgent prob-lem to be solved. The subordination standard has strong flexibility and can still accommodate the employment relationship under the new format, but to solve the problem of the protection of labor rights and interests of online car-hailing drivers, it is necessary to make appropriate breakthroughs in the traditional identification standards. Among the various breakthrough methods, “derogation of labor relations” is actually preferable, and the labor “law of thirds” implements this method. At present, my country should actively fill the gap of the labor benchmark system in the car-hailing industry, formulate a model of industry general agreement, and speed up the implementation of the protection of the labor rights and interests of car-hailing drivers.
