我国正当防卫时间条件的认定

Identification of the Time Condition of Justifiable Defense in China

摘要: 正当防卫作为刑法中阻却违法性事由之一，在刑法的犯罪成立理论构造中具有十分重要的地位，备受学者们的关注。然而，我国对于正当防卫时间条件的认定却少有学者进行研究，但其又在司法实践层面常常被使用。因此，为解决正当防卫时间条件的认定所存在的难题，本文试图通过案例出发，揭示出其中的理论问题，从而引发对于正当防卫时间条件的认定这一核心问题的思考，对我国相关概念与学说进行深入剖析，努力探究我国认定背后的困境与原因，并针对存在的困境及原因提出相应的建议，达到准确把握正当防卫时间条件的认定标准的目标。

Abstract: As one of the reasons of pre-venting illegal acts in criminal law, justifiable defense has a very important position in the theoret-ical structure of criminal law, and has attracted the attention of scholars. However, few scholars have studied the identification of the time condition of justifiable defense in China, it is often used in judicial practice. Therefore, in order to solve the problems existing in the identification of the time conditions of justifiable defense, this paper attempts to reveal the theoretical problems through cases, thus triggering thinking on the core issue of the identification of the time conditions of justi-fiable defense, deeply analyzing the relevant concepts and theories in China, trying to explore the difficulties and reasons behind the identification in China, and putting forward corresponding sug-gestions for the existing difficulties and reasons, to achieve the goal of accurately grasping the iden-tification standard of justifiable defense time conditions.
