Difficulties and Suggestions on the Implementation of Informed Consent Rules for App Users

摘要: 契约自由精神要求契约的签订应当是对契约权利义务及后果充分知晓的选择。个人信息保护法第13条、第14条规定知情同意规则应出于个人的完全自愿，……知情同意规则满足了一切形式要求，但在技术提升，商家专业化突出的背景下，知情同意规则流于形式。法律规定执行难度大，使用者与App运营商地位不平等，使用者无选择权，究其本质在于个人信息的商业价值越发凸显。以多元化的视角构建适应社会发展的知情同意规则势在必行。

Abstract: The spirit of freedom of contract requires that the signing of contract should be a choice fully aware of the rights, obligations and consequences of contract. Articles 13 and 14 of the Personal Information Protection Law stipulate that the informed consent rule shall be made on the individual’s own free will... Informed consent rules meet all forms of requirements, but under the background of technological improvement and prominent business specialization, informed consent rules become mere formality. The implementation of legal provisions is difficult, the status of users and App operators is not equal, and users have no choice. The essence of this rule lies in the increasingly prominent commercial value of personal information. It is imperative to construct informed consent rules adapted to social development from a diversified perspective.
