论网络版权侵权错误通知赔偿责任的完善与适用

Study on the Improvement and Application of the Liability for Misrepresentation of Online Copyright Infringement

摘要: 权利人利用“通知与删除”规则发送错误通知导致网络用户权益受损的情形在网络版权领域多有发生，而我国著作权法中与之对应的错误通知赔偿责任制度规定在《信息网络传播权保护条例》第24条。该条的制度设计较为抽象，对该责任的归责原则及过错认定标准等问题缺乏明确规定。本文通过梳理立法国内制度并考察域外司法经验，尝试厘清该责任的归责原则，辨明其责任形态并确认相应认定标准，以期在实现权利人与网络用户利益平衡的基础上，为短视频版权纠纷所面临的新问题提供合适的解决路径。

Abstract: Where the right holder uses the “Notice and Takedown” rule to send a wrong resulting in the damage of the rights and interests of the network users, has occurred frequently in the field of online copyright. The corresponding liability system for erroneous notification is stipulated in Article 24 of the Regulations on Protection of Information Network Transmission Right. The Article is rather abstract which lacks clear provisions on the attribution principle and fault determination standard. By combing the legislative and domestic systems and examining the judicial experience abroad, this essay attempts to clarify the principle of liability, identify the form of liability and confirm the corresponding criteria, in order to provide a suitable solution to the new problems faced by copyright disputes related to short videos on the basis of achieving a balance between the interests of the right holder and the network users.
