“三权分置”背景下农村土地流转法律问题研究——以湖南省为例

Research on Legal Issues of Rural Land Transfer under the Background of “Separation of Three Rights”—In Hunan Province as an Example

摘要: 随着“三权分置”制度的深入发展，农村土地流转方式愈发丰富、土地流转规模不断发展、土地附加利益也不断增加。但与此同时，在土地流转过程中涉及土地纠纷的案件数量也随之增加。通过对湖南省2020年1月至2022年8月涉及土地流转的相关民事判决书的诉讼主体、诉讼类型以及诉讼请求进行整理分析，可以发现在土地流转过程中存在农村集体经济组织成员资格认定的标准不明晰、农民法律意识薄弱等法律问题。因此，需通过完善农村集体经济组织成员资格的认定标准、提高农民法律意识来有效预防和化解农村土地流转纠纷，以促进农村土地流转市场的良好运转与健康有序发展。

Abstract: With the in-depth development of the “three rights separation” system, the rural land transfer mode is increasingly rich, the scale of land transfer continues to develop, and the additional interests of land are also increasing. But at the same time, the number of cases involving land disputes in the process of land transfer also increases. By sorting out and analyzing the litigation subjects, litigation types and litigation requests of civil judgments related to land transfer in Hunan Province from January 2020 to August 2022, it can be found that there are legal problems in the process of land transfer, such as unclear standards for the identification of rural collective economic organization membership and weak legal awareness of farmers. Therefore, it is necessary to effectively pre-vent and resolve rural land transfer disputes by improving the qualification criteria of rural collec-tive economic organizations and raising farmers’ legal awareness, so as to promote the good opera-tion and healthy and orderly development of rural land transfer market.
