未经许可的演绎作品著作权保护之研究
A Study of Copyright Protection for Unauthorised Interpretative Works
摘要: 互联网时代下,信息流通速度加快。“用户创造内容”在互联网条件下成为一种非常普遍的现象。然而我们可以发现,许多创作实质上是对其他作品的演绎,并且由于该演绎行为并未经过原作品著作权人的许可,由此引发了一系列著作权侵权风险,在此种情况下,法院一般会判令停止侵权。但我们也不可否认许多优秀的演绎作品的创作者提供了大量创造性劳动,如果无法给予未经许可的演绎作品足够的保护,则可能造成对演绎作品的作者显失不公的结果。本文旨在探讨当前对未经许可的演绎作品的著作权保护以及尝试探讨如何通过制度完善平衡原作品作者的利益和演绎作品的作者利益。
Abstract: In the age of the Internet, the flow of information is accelerating. “User-created content” has become a very common phenomenon under Internet conditions. However, we can see that many of these creations are essentially renditions of other works, and because the rendition is not per-mitted by the copyright owner of the original work, this raises a number of risks of copyright in-fringement, in which case the courts will generally order the infringement to cease. However, there is no denying that the creators of many excellent interpretations provide a great deal of creative work, and failure to give sufficient protection to unauthorised interpretations may result in a mani-fest injustice to the author of the interpreted work. The purpose of this article is to discuss the cur-rent copyright protection of unauthorised interpretations and to try to explore how to balance the interests of the author of the original work with those of the author of the interpreted work through institutional improvements.
