The Problem and Treatment of Network Financial Crime

摘要: 当今时代，是“互联网+”的时代，随着网络的快速发展，带来的好处遍及人们生活的方方面面，互联网的蓬勃发展，带动了各个行业朝向好的方向发展，当然，也带动了网络金融的发展。但互联网是一把双刃剑，如果使用不好，同样会给人们带来危害，在现实生活中，由于互联网快速发展，而与之相对应的法律不完善或相对滞后，这就会使一些图谋不轨的人在网络上钻法律的漏洞，从而导致网络金融犯罪现象与日俱增。为了完善治理网络金融犯罪，本文从研究网络金融的现状和原因出发，首先陈述一下网络金融犯罪的特点，然后从多个角度对网络金融犯罪的成因进行分析，最后探寻治理网络金融犯罪的对策，该部分主要是从加强网络金融市场的法律监督入手，结合完善刑事立法和司法，从而达到治理网络金融犯罪的目的。

Abstract: Today is the era of “Internet plus”. With the rapid development of the network, the benefits brought by it cover all aspects of people’s lives. The vigorous development of the Internet has driven all industries to develop in a good direction, and of course, it has also driven the development of network finance. However, the Internet is a dou-ble-edged sword. If it is not used well, it will also bring harm to people. In real life, due to the rapid development of the Internet, while the corresponding laws are not perfect or relatively backward, which will make some people with evil intentions drill holes in the law on the network, leading to the growing phenomenon of online financial crimes. In order to improve the governance of network financial crimes, this paper starts from the study of the current situation and causes of network fi-nance, first states the characteristics of network financial crimes, then analyzes the causes of net-work financial crimes from multiple perspectives, and finally explores the countermeasures for governance of network financial crimes. This part mainly starts from strengthening the legal super-vision of the network financial market, combined with improving criminal legislation and justice, so as to achieve the goal of controlling network financial crimes.
