浅谈人工智能产品侵权责任承担

Discussion on the Infringement Liability of Artificial Intelligence Products

摘要: 随着科技的进步和社会实践的发展，人工智能产品开始渗透到社会生活的方方面面，由此而带来的社会问题、法律争议也逐渐引起社会各界的广泛关注。就人工智能侵权而言，随着技术的不断发展成熟，人工智能产品逐步取得类人化的“思考能力”。这种情况下，人工智能产品是否会突破其客体性？倘若赋予人工智能产品以拟制人格，在立法上是否具有可行性，其具体条件而何，以及其适应社会发展的必要性何在？本文将围绕上述问题进行讨论，并尝试就人工智能产品侵权责任承担问题浅谈一点自己的看法。

Abstract: With the progress of science and the development of social practice, artificial intelligence products (“AI products”) have begun to penetrate into all aspects of our lives, and the social problems and legal disputes brought about by them have gradually aroused exten-sive attention from all walks of life. As far as the infringement is concerned, which is made by artifi-cial intelligence product. The AI products have gradually acquired the “thinking ability” of humani-zation, with the continuous development and maturity of technology. Under this circumstance, will artificial intelligence products break through its objectivity? If the AI products are endowed with legal personality, whether it’s feasible in legislation, what are the specific conditions and where is the necessity for it to adapt to social development? This paper will focus on the issues mentioned above, and try to talk about my own views on the infringement liability of artificial intelligence products.
