局部外观设计专利的侵权判定规则探析

Analysis on the Rules of Judging the Infringement of Local Design Patent

摘要: 我国《专利法》第四次修改增加了局部外观设计，实务界并没有形成一套侵权判定规则，现有的局部外观设计侵权判定方法存在许多不合理之处。例如“整体观察，综合判断”的适用存在主观性较强等缺陷、过于考虑产品属性而导致判决结果不公平、原有的侵权判定主体已不再适应局部外观设计“精细化”的特点。解决以上问题，应立足于现有的整体外观设计侵权判定规则，将相关内容衔接继承到局部外观设计侵权判定中，如此才能实现由整体保护向局部保护的渐变。

Abstract: The Fourth Amendment of the Patent Law of our country has added the local design, and there is not a set of rules for judging the infringement of the local design. For example, the application of “Overall observation, comprehensive judgment” has some defects such as strong subjectivity, over-consideration of product attributes leads to unfair judgment results, and the original subject of tort judgment no longer adapts to the characteristics of local design “Refinement”. In order to solve the above problems, we should base on the existing rules of judging the whole design infringement, and inherit the related content to the local design infringement, so as to realize the gradual change from the whole protection to the local protection.
