试析公检法三机关互相制约原则与检察机关法律监督不同的功能定位

An Analysis of the Principle of Mutual Restriction among the Three Organs of the Public Security, Procuratorate and Law and the Different Functional Orientation of the Legal Supervision of the Procuratorate

摘要: 公安机关、人民检察院、人民法院进行刑事诉讼需要遵循分工负责、互相配合、互相制约的原则，尤其是互相制约原则，实际有效地确保了法律的执行。人民检察院本身属于法律监督机关，属于一种专门性、程序性的监督，对法律实施中严重违反国家法律的情况进行监督，和公检法相互制约原则的功能定位存在较大的差异。本文就公检法三机关互相制约原则功能定位、检察机关法律监督的功能定位进行对比分析，阐述两者存在的不同。

Abstract: The public security organs, the People’s Procuratorates and the People’s Courts should follow the principles of division of labor and respon-sibility, mutual cooperation and mutual restriction when conducting criminal proceedings, espe-cially the principle of mutual restriction, which effectively ensures the implementation of the law. The People’s Procuratorate itself is a legal supervision organ, which belongs to a specialized and procedural supervision. It supervises serious violations of national laws in the implementation of laws, which is quite different from the functional orientation of the principle of mutual restriction of the public procuratorate law. This paper makes a comparative analysis of the functional orientation of the principle of mutual restriction among the three organs of the public security organs, the procuratorial organs and the legal supervision of the procuratorial organs, and expounds the dif-ferences between the two.
