新闻媒体职务作品列入特殊职务作品的法经济学分析

Economic Analysis of Law of the Inclusion of News Media Service Works in Special Service Works

摘要: 我国《著作权法》第三次修正将新闻媒体职务作品由默认的一般职务作品调整为特殊职务作品。法经济学与著作权法在理念上具有相通之处，著作权法是法经济学分析的天然领域，本文试从法经济学角度分析新闻媒体行业格局变化和将新闻媒体职务作品确立为特殊职务作品的影响，以期提出提高作品产出与利用效率的改进与完善措施。

Abstract: The third amendment of China’s Copyright Law adjusted the news media service works from the default general service works to special service works. This paper tries to analyze the impact, advantages and disadvantages of the change of the news media industry pattern and the establishment of news media service works as special service works from the perspective of legal economics, with a view to proposing improvement and perfec-tion measures to enhance the efficiency of the output and utilization of works.
