论彩礼返还规则的司法困境与出路——以王鹏与徐丽丽彩礼返还案为例

On the Judicial Dilemma and Outlet of the Return Rules of Bride Gifts—Taking the Return Case of Wang Peng and Xu Lili as an Example

摘要: 彩礼在我国有着深厚的渊源，虽然在我国婚姻家庭编中关于婚姻关系的成立部分并没有规定必须给付彩礼男女婚姻关系才成立，但是作为民间习俗，已经成为了人们不约而同的约定，在正式办理结婚登记手续前，一般都需要男方向女方给付一定数额的彩礼。《中华人民共和国民法典》婚姻家庭编的解释(一)第五条规定了彩礼的返还制度，但是规定的较为模糊，在实践的适用上还存在些许问题，基于此本文将通过典型案例的切入为重点，以求真实展示彩礼返还制度的司法适用情况，在此基础上发现问题并展开理论研究，做到有的放矢；力图从适用现状入手发现我国彩礼返还制度是如何认定和适用的以及还有哪些不足之处，结合具体问题进行详细分析梳理，希望提出完善我国彩礼返还制度的建议。

Abstract: Bribery has a deep origin in China. Although the establishment of marriage relationship in the Marriage and Family Code of China does not stipulate that the marriage relationship between men and women must be established by paying the bride price, as a folk custom, it has become a common agreement. Before going through the marriage registration formalities, men generally need to pay a certain amount of bride price to women. The interpretation of the Civil Code of the People’s Republic of China on Marriage and Family (1) Article 5 stipulates the return system of bride price, but the provisions are vague, and there are still some problems in the application of practice. Based on this, this paper will focus on typical cases to truly show the judicial application of the return system of bride price. On this basis, it will find problems and conduct theoretical research to achieve a targeted goal; It tries to find out how to identify and apply the return system of betrothal gifts in China and what shortcomings it has from the perspective of the current application situation. It analyzes and combs the specific problems in detail and hopes to put forward suggestions for improving the return system of betrothal gifts in China.
