摘要: 作品登记制度兼具法律和经济双重意义，但归根到底服务于著作权价值实现之经济意义。作品登记证书的“初步证据”作用是作品登记公信力在证据法上的延伸。作品登记证书的生命在于推定力而非证明力，其本质为可推翻的一重的著作权权属推定，证明力上并不较其他权利证明方式更优。审判中存在将登记证书的推定功能不当扩大为包含权利存在推定在内的双重权利推定的错误倾向，有必要以司法解释形式设置相应的注意规定来克服此类司法异化。

Abstract: The registration system of works has both legal and economic significance, but ultimately serves the economic significance of copyright value realization. The “prima facie” role of the work registration certificate is an extension of the credibility of the work registration in the law of evidence. The life of a work registration cer-tificate lies in its presumptive power rather than its probative power, and its essence is a rebuttable presumption of copyright ownership, and its probative power is not superior to that of other forms of proof of rights. There is an erroneous tendency to improperly expand the presumption function of registration certificate into a double presumption of right including the presumption of existence of right in the trial, and it is necessary to set corresponding attention provisions in the form of judicial interpretation to overcome such judicial alienation.
