论注销户籍的法律效果——以打击境外电信网络诈骗为视角

On the Legal Effects of Household Registration Cancellation: From the Perspective of Combating Overseas Telecommunications Network Fraud

摘要: 户籍与国籍的功能不同，但二者联系十分紧密。通常认为户籍是纯粹的国内事项，户籍的登记、变更及注销并不会对国籍产生直接影响。但基于打击境外电信网络诈骗的背景下，根据各地公安机关发布的公告，注销滞留缅北的涉诈人员户籍将会对其国籍甄别产生影响。以此为视角，需要对此种情况下注销户籍的法律效果进行分析，并且明晰其对国籍的影响，以及在实践中是否会产生争议。

Abstract: The functions of household registration and nationality are different, but the two are closely linked. It is generally considered that the household registration is a purely domestic matter, and the registration, change and cancellation of the household registration will not have a direct impact on the nationality. However, in the context of cracking down on overseas telecommunications net-work fraud, according to announcements issued by local public security organs, the cancellation of the household registration of fraud-related persons stranded in northern Myanmar will have an impact on their nationality screening. From this perspective, it is necessary to analyze the legal ef-fects of deregistration, in such cases, and clarify its impact on nationality and whether disputes will arise in practice.
