浅析法与道德的关系

Analysis of the Relationship between Law and Morality

摘要: 随着我国社会的逐步发展和相关法制体系的逐渐完善，法与道德的关系问题越来越成为法理学领域中的一大热点。法与道德都是上层建筑的一部分，法属于政治上层建筑，是制度层面的；道德属于观念上层建筑，是意识形态层面的。正如人的两只手掌，看似一模一样，实则略有不同。本文基于法与道德的基本含义，从各个方面分析了二者的相生相合关系。

Abstract: With the gradual development of Chinese society and the gradual improvement of the relevant legal system, the relationship between law and morality has become a hot spot in the field of jurisprudence. Law and morality are a part of the superstructure, law belongs to the political superstructure, is the system level; morality belongs to the conceptual superstructure, is the ideological level, just like the two palms of a person, seemingly exactly the same, but actually slightly different. Based on the basic meaning of law and morality, this paper analyzes the corresponding relationship between the two from various aspects.
