事先达成的继承协议效力探析

摘要: 我国现行法提供了遗嘱、遗赠和遗赠扶养协议三种法律制度来实现被继承人的遗嘱自由，但仍然存在一些不足。结合我国社会的实际情况，在继承协议没有违背强制性法规和公序良俗的前提下，认可事先达成的继承协议的效力可以更好地实现被继承人的意思自治。同时，各继承人之间所达成的赡养继承协议可认可其在继承人之间的法律拘束力，不影响被继承人的赡养请求权。

Abstract: The current law of our country provides three legal systems of will, legacy and legacy maintenance agreement to realize the freedom of testament of the heirs, but there are still some deficiencies. According to the actual situation of our society, on the premise that the inheritance agreement does not violate the mandatory laws and regulations and the public order and good customs, recognizing the validity of the inheritance agreement reached in advance can better realize the autonomy of the will of the heirs. At the same time, the maintenance and inheritance agreement reached between the heirs can recognize their legal binding force between the heirs, and does not affect the mainte-nance claim of the heirs.
