Conflict of Laws Issues of Virtual Currency

摘要: 虚拟货币是互联网时代的新兴产物。目前，法学理论界对于虚拟货币的讨论主要集中在法律属性、金融监管和刑法规制等问题上，少有学者以冲突法视角对虚拟货币进行研究。但是，虚拟货币的无国界属性以及其底层技术区块链的运作原理，使得虚拟货币纠纷难免具有涉外性，面临法律适用的难题。因此，本文将从冲突法视角出发，剖析了传统冲突法理论下虚拟货币纠纷可能面临的问题，并建议构建专属于虚拟货币的冲突法框架和借助统一冲突法公约来扫清虚拟货币法律适用的障碍。

Abstract: Virtual currency is a new product of the Internet era. Currently, legal theoretical discussions on virtual currency mainly focus on issues such as legal attributes, financial regulation, and criminal law regulation, and few scholars have studied virtual currency from the perspective of conflict of laws. However, the borderless nature of virtual currency and the operating principles of its under-lying technology, blockchain, make it inevitable for virtual currency disputes to have foreign ele-ments and face difficulties in the application of law. Therefore, this article will analyze the problems that virtual currency disputes may face under the traditional conflict of laws theory from the per-spective of conflict of laws, and propose to construct a conflict of laws framework exclusive to virtual currency and to use a unified conflict of laws convention to remove the obstacles to the legal appli-cation of virtual currency.
