夫妻忠诚协议效力“穿透式”类型化研究

Study on the “Penetrating” Typing of Marital Loyalty Agreement Effectiveness

摘要: 司法实践中越来越多的夫妻会在婚前或婚后订立忠诚协议。但由于法律对此类协议的属性和效力未予明确以及相关司法解释的规定未能制度化。关于夫妻忠诚协议的性质认定、效力认定、以及法律适用众说纷纭，笔者认为在实践中，对婚姻忠诚协议内容应当分为两类，分别为：不具有夫妻财产约定性质与具有夫妻财产约定性质的婚姻忠诚协议。继而根据约定内容将“忠诚协议”作类型化区分，由此明确司法保护的范围，用“穿透式”审判思维依据具体内容细化为：身份变化型、财产承担型、混合型、自由限制型的四种子模式忠诚协议。最后，法官宜遵循类型化的思路，借助忠诚协议内容约定的具体化解释，对婚内协议的效力进行更为细致的价值判断。

Abstract: In judicial practice, more and more couples will conclude loyalty agreements before or after marriage. However, the lack of legal clarity on the nature and effect of such agreements and the provisions of relevant judi-cial interpretations have not been institutionalized. There are different opinions on the nature, va-lidity, and legal application of the marital loyalty agreement. In practice, the author believes that in practice, the content of the marital loyalty agreement should be divided into two categories: the absence of the marital property agreement and the nature of the marital property agreement. Then, according to the agreed content, the “loyalty agreement” is made to be typed, so that the scope of judicial protection is clearly defined, and the “penetrating” trial thinking is refined into the four-seed mode of loyalty agreement: identity change type, property undertaking type, mixed type, and freedom and restriction type. Finally, judges should follow the idea of typing and make a more detailed value judgment on the effectiveness of the marital agreement with the help of the specific interpretation of the content of the loyalty agreement.
