我国网络谣言侵权行为治理现状及优化路径研究

Research on the Status Quo and the Optimization Path for the Governance of Online Rumour Infringement in China

摘要: 清朗空间是网络世界健康发展的基础，而层出不穷的网络谣言严重破坏了互联网运行秩序，用法律的手段来规制网络谣言侵权行为是法治中国建设的应有之义。本文主要从实践出发，分析我国网络谣言法律规制现状，剖析实名制制度和社会信用评价体系所存问题，并对域外相关制度进行分析，借鉴其中先进经验，提出有针对性的建议，如完善现有防范手段和将公益诉讼、检察院支持起诉等手段引入到网络谣言侵权案件的事后救济措施当中，为突破网络谣言侵权预防和救济手段缺乏的困境起到一定的推动作用。

Abstract: A clear space is the basis for the healthy development of the online world, and the endless online rumors have seriously damaged the operation order of the Internet, so the use of legal means to regulate the infringement of online rumors is the right thing to do for the construction of China under the rule of law. This paper analyzes the current situation of legal regulation of online rumours in China, analyzes the problems of the real-name system and the social credit evaluation system, and analyzes the relevant systems in foreign countries, draws on their advanced experience and puts forward targeted suggestions, such as improving the existing pre-ventive measures and introducing public interest litigation and prosecutorial support into the post-event relief measures of online rumour infringement cases, in order to break through the lack of preventive and remedial measures of online rumour infringement. This will help to break through the dilemma of the lack of prevention and remedies for online rumour infringement.
