摘要: 居住权制度入典，为家事关系领域中的弱势群体提供了完善的住房保障。在社会公共领域，从出于“住有所居”的目的，居住权制度也为公共住房保障制度发展提供了新的可能路径，在住房保障制度中引入居住权制度，可以克服传统的产权型保障住房和租赁型保障住房所面临的土地供应难题和住房不稳定等问题。在已有的居住权制度下，通过对居住权制度的规范解释，明晰居住权制度住房保障功能的实现路径。

Abstract: The introduction of the right of abode system into the code has provided the disadvantaged groups in the field of domestic relations with perfect housing security. In the public sector, the right to housing system also provides a new possible path for the development of public housing security system for the purpose of “housing for all”. The introduction of the right to housing system in the housing security system can overcome the problems of land supply and housing instability faced by the traditional housing security system of property rights and rental housing. Under the existing right of abode system, the path of realizing the housing security function of the right of abode system is clarified through the normative interpretation of the right of abode system.
