同居析产纠纷中财产分割问题研究

Research on Property Division in Cohabitation Dispute

摘要: 随着近年来传统婚姻观念的转变，解除同居关系的纠纷越来越多，司法机关在办理此类案件时，面对的是复杂的财产认定和财产法律关系梳理，由于同居关系的复杂多样，处理时存在许多问题，例如缺乏明确的适用程序和标准，导致执行标准不一致。本文通过梳理同居关系的概念与分类，梳理同居析产纠纷认定中的难点，寻求财产法律关系认定的出路，从而达成同居析产纠纷的解决。

Abstract: With the change of traditional marriage concept in recent years, there are more and more disputes over the dissolution of cohabitation. When handling such cases, judicial organs are faced with com-plicated property identification and property legal relationship sorting. Due to the complexity and diversity of cohabitation relationships, there are many problems in handling, such as the lack of clear application procedures and standards, resulting in inconsistent implementation standards. By sorting out the concept and classification of cohabitation relationship, sorting out the difficulties in the identification of cohabitation property dispute, this paper seeks the way out of the identification of property legal relationship, so as to achieve the settlement of cohabitation property dispute.
