摘要: 人工智能产业的发展正如日中天，以无人驾驶汽车为代表的新兴科技产物正给我国现行刑法带来新的机遇与挑战。无人驾驶汽车肇事行为相关责任认定与归属成为法学界争议的焦点。本文通过对无人驾驶汽车人格的探讨，在明确了无人驾驶汽车不具备刑事主体资格的基础上，对各类可能存在的刑事责任主体及其可能承担的责任进行分析，并由此提出在我国现行刑法框架下对无人驾驶汽车肇事行为进行规制的路径，为解决相关疑难争议问题提供一定的参考与借鉴。

Abstract: The development of the artificial intelligence industry is booming. The emerging technological products represented by driverless vehicles are bringing new opportunities and challenges to China’s current criminal law. The identification and attribution of responsibilities related to driverless vehicle accidents have become the focus of controversy in the legal field. Based on the discussion of the personality of driverless vehicles, this article clarifies that driverless vehicles do not have the qualification of criminal subject, analyzes various possible criminal liability subjects and their possible responsibilities, and proposes a path to regulate driverless vehicle accidents within the framework of China’s current criminal law, providing some reference for solving related difficult and controversial issues.
