知识产权保护视域下侵害商业秘密的惩罚性赔偿研究

Research on Punitive Compensation for Infringement of Trade Secrets from the Perspective of Intellectual Property Protection

摘要: 自惩罚性赔偿制度引入知识产权领域以来，学界对其适用规则和运行机制探讨不断。本文自知识产权视域出发，通过阐述商业秘密的深刻内涵，依据现行有效的法律规范及相关司法解释，并结合最高人民法院发布的指导案例，按照惩罚性赔偿之适用条件与计算方法的清晰脉络，正面回答了如何准确适用该规则及如何计算赔偿数额的问题，旨在明确商业秘密侵权的惩罚性赔偿适用标准，以规范和引导社会主义市场经济竞争秩序。

Abstract: Since the punitive compensation system was introduced into the field of intellectual property, the academic circle has been discussing its applicable rules and operating mechanism continuously. From the perspective of intellectual property rights, this paper directly answers the questions of how to accurately apply the rules and how to calculate the amount of compensation by elaborating the profound connotation of trade secrets, according to the current effective legal norms and relevant judicial interpretations, combined with the guidance cases issued by the Supreme People’s Court and in accordance with the clear context of the applicable conditions and calculation methods of punitive damages. The purpose is to clarify the applicable standards of punitive damages for trade secret infringement so as to standardize and guide the competition order of socialist market economy.
