海底电缆和管道的“合理顾及”义务研究
Study on the Reasonable Regard for Submarine Cables and Pipelines
摘要: 海底电缆和管道是世界各国最重要的通信和能源基础设施,采取一切必要措施保护海底电缆和管道是国际社会的共识。关于海底电缆和管道保护的国际条约中对“合理顾及”义务的定义及要求较为模糊,无法为海底电缆和管道保护提供明确的实体和程序性指引。明确不同主体在“合理顾及”义务的要求下应承担的区别性义务,有利于保护海底电缆和管道与其他海洋活动之间的平衡。
Abstract:
It is the consensus of the international community to take all necessary measures to protect submarine cables and pipelines, which are the most important communication and energy infrastructure of all countries in the world. The definition and requirement of the obligation of “reasonable regard” in the international treaties on the protection of submarine cables and pipelines are too vague to provide clear substantive and procedural guidelines for the protection of submarine cables and pipelines. It would help to protect the balance between submarine cables and pipelines and other Marine activities by clarifying the differentiated obligations of different parties under the obligation of “reasonable regard”.
