新媒体时代隐私权侵权与法律规制研究——以“人肉搜索”为视角

Research on Privacy Infringement and Legal Regulation in New Media Era—From the Perspective of “Human Flesh Search”

摘要: 随着新媒体时代的到来，通过互联网获取所需要的信息已经成为当下人们求知解惑的重要渠道。社交网络在给受众带来便利的同时，也让受众隐私愈发透明。以“人肉搜索”这一现象为例，它在给受众提供便捷的同时，也在每时每刻对隐私权构成威胁甚至引发侵权纠纷，故对新媒体时代隐私权的侵权问题与法律规制展开研究是极具有现实意义的。文章首先对“人肉搜索”进行界定，并阐述其在新媒体时代下的法律特征为：行为主体众多、信息传播迅速、行为后果影响广泛。其次，对新媒体时代下“人肉搜索”涉及的隐私侵权问题进行了研究，最后，从完善立法、技术防治、道德自律等方面提出建议以期对隐私保护的实践运作产生积极影响。

Abstract: With the advent of the new media era, it has become an important channel for people to obtain the information they need through the Internet. Social networks not only bring convenience to audiences, but also make their privacy more transparent. Taking the phenomenon of “human flesh search” as an example, it not only provides convenience to the audience, but also poses a threat to the right of privacy and even causes infringement disputes all the time. Therefore, it is of great practical significance to study the right of privacy infringement and legal regulations in the new media era. The article first defines “human flesh search”, and expounds its legal characteristics in the new media era: numerous subjects of behavior, rapid dissemination of information, behavior consequences of extensive influence. Secondly, it studies the privacy infringement issues involved in “human flesh search” in the new media era. Finally, it puts forward suggestions from the aspects of improving legislation, technical prevention and control, moral self-discipline, etc., in order to have a positive impact on the practice operation of privacy protection.
