Study on the Right of Immediate Termination of Workers

摘要: 劳动者即时解除是劳资双方存续期间很重要的一个环节，即时解除权的行使既关系到劳动者的生活保障来源和工作选择的自由，又关乎用人单位的员工管理秩序和生产经营状况；解除权对劳动关系的影响具有举足轻重的作用。随着时代发展，现行立法规定已无法继续满足复杂多变的现实情况。本文开始对即时解除权的概念和特征进行阐释；然后对现行立法规定进行梳理，结合当下对即时解除权的使用情况，从而找出现行立法的不足之处；提出笔者对我国现行立法的一些建议和看法。

Abstract: Immediate dismissal of workers is a very important link during the existence of both labor and capital. The exercise of the right of immediate dismissal is not only related to the freedom of workers’ sources of livelihood and job choices, but also related to the management order and production status of employees of the employing unit. The right of termination plays a role of labor relation of the influence. With the development of the times, the current legislative provisions can no longer meet the complicated and changeable reality. This article begins to explain the concept of the right of immediate release. Secondly, by combing the current legislative provisions and combining the current use of the right of immediate release, we can find out the shortcomings of the current legislation. The author puts forward some opinions on the current legislation of our country.
