机构养老服务合同法律问题探析

摘要: “十四五”以后，中国将进入快速老龄化发展期。“独生子女”的父母将成为老年人群的重要组成部分，其消费理念、消费能力、需求格局将发生明显变化，对居家照料、康复护理、心理慰籍、安宁疗护等服务的需求将不断释放，解决这些问题必须充分发挥市场的作用，提高资源的配置效率。因此，中国老龄产业的发展将迎来重大历史机遇期，其中机构养老服务的需求会大量增加。目前没有相关的系统的法律法规对养老服务合同进行规定，所以造成了各地裁判的不一。本文对机构养老服务合同的基础理论，机构养老服务合同的主体，机构养老服务合同的内容与履行等法律问题进行了研究。

Abstract: After the 14th Five Year Plan, China will enter a period of rapid aging development. Parents of “only children” will become an important component of the elderly population, and their consumption philosophy, consumption ability, and demand pattern will undergo significant changes. The demand for home care, rehabilitation care, psychological comfort, and hospice care services will continue to be released. To solve these problems, it is necessary to fully play the role of the market and improve the efficiency of resource allocation. Therefore, the development of China’s elderly care industry will usher in a period of significant historical opportunities, with a significant increase in demand for institutional elderly care services. At present, there are no relevant systematic laws and regulations regulating elderly care service contracts, which has led to varying judgments in different regions. This article studies the basic theory of institutional elderly care service contracts, the subject of institutional elderly care service contracts, the content and performance of institutional elderly care service contracts, and other legal issues.
