侵权不停止在著作权侵权案件中的适用研究

摘要: 随着信息社会的发展，需要对停止侵害请求权予以一定程度的限制，在特殊情形下需采用侵权不停止的做法。对于侵权不停止在著作权侵权纠纷中的适用条件等应作出相应规定，同时还要探寻侵权不停止的替代措施，对著作权人的权利进行补救。在讨论适用条件时，要考虑侵权人主观上是否是善意、适用侵权不停止是否符合经济理性的要求、是否涉及到公共利益以及是否能以其他替代措施对著作权人的权利进行弥补。对于替代措施则需要细分是货币性措施还是非货币性措施，在救济时要遵循全面救济原则。

Abstract: With the development of information society, it is necessary to restrict the right to stop infringement to a certain extent, and in special cases, it is necessary to adopt the practice of not stopping infringement. It is necessary to make corresponding provisions on the applicable conditions of non-stopping infringement in copyright infringement disputes, and explore alternative measures to remedy the rights of copyright owners. When discussing the application conditions, it is necessary to consider whether the infringer is subjectively in good faith, whether the application infringement does not stop meets the requirements of economic rationality, whether it involves the public interest and whether other alternative measures can be taken to make up for the rights of copyright owners. The alternative measures should be subdivided into monetary measures or non-monetary measures, and the principle of comprehensive relief should be followed during relief.
