公众人物隐私权与公众知情权的冲突与权衡

The Conflict and Balance between the Public Figure’s Right to Privacy and the Public’s Right to Know

摘要: 这些年来，随着我国经济的高速发展，人民的生活水平得到了很大的提高，对精神文化的需求也随之提升。为了丰富精神生活，越来越多的人将目光投向了公众人物，而过度的关注所带来的结果是公众人物的隐私权受到了很大的侵犯，在公众人物的“隐私权”与公众的“知情权”之间便由此产生了极为明显的冲突。为了在公众人物隐私权与公众知情权的冲突之间找到一个协调的方案，可从三个方面对公众人物隐私权与公众知情权之间的关系进行分析与研究。首先，对公众人物隐私权与公众知情权进行一个概述。在探讨公众人物如何界定的同时，大致阐述一下公众人物隐私权与公众知情权的基本概念与理论。其次，直截了当的指出我国目前对公众人物隐私权与公众知情权的立法现状及产生的问题，进而分析二者之间冲突的原因。最后，针对二者的冲突提出切实可行的方案，将二者的利益进行协调。

Abstract: These years, with the rapid development of our economy, the living standards of the people have been greatly improved, and the demand for spiritual culture is also enhanced. In order to enrich the spiritual life, more and more people turn their attention to public figures. As a result of excessive attention, the privacy rights of public figures have been greatly violated, resulting in an obvious conflict between the “privacy rights” of public figures and the “right to know” of the public. In order to find a coordinated plan between the public figures’ right to privacy and the public’s right to know, the relationship between the public figures’ right to privacy and the public’s right to know can be analyzed and studied from three aspects. First of all, an overview of the privacy of public figures and the public’s right to know. While discussing how to define public figures, this paper expounds the basic concepts and theories of public figures’ right to privacy and public’s right to know. Secondly, it points out directly the current legislation status and problems of the public figures’ right to privacy and the public’s right to know, and then analyzes the reasons for the conflict between the two. Finally, it is to put forward a feasible plan for the conflict between the two and coordinate their interests.
