新媒体时代下引入新闻出版者邻接权的思考

Reflections on the Introduction of News Publishers’ Neighboring Rights in the New Media Era

摘要: 传统新闻出版业承担着重要社会使命，但随着互联网技术的发展和新媒体时代的到来，我国新闻出版业的发展遭受到前所未有的冲击，当前对其进行保护的法律模式也存在着缺陷。文章认为：我国可以适时将新闻出版者权纳入邻接权体系。新闻出版者权符合邻接权的历史逻辑，在我国也有适用的空间，将其纳入邻接权体系具有合理性。此外，新闻出版者权有着重要的制度价值，具有破解新闻出版业发展困境的可行性。

Abstract: The traditional news publishing industry bears an important social mission. However, with the development of Internet technology and the arrival of the new media era, the development of China’s news publishing industry has suffered an unprecedented impact, and the current legal model to protect it also has defects. The article holds that China can bring the news publisher’s right into the neighboring right system in due course. News publisher’s right conforms to the historical logic of neighboring rights, and it also has room for application in China, so it is reasonable to bring it into the neighboring rights system. In addition, the right of news publishers has important institutional value and is feasible to solve the development dilemma of news publishing industry.
