Legal Risks and Responses of Virtual Society in the Perspective of Metaverse Governance

摘要: 随着区块链、人工智能和增强现实技术的日益成熟，数字化生存逐渐成为人类生活新模式，“元宇宙”也慢慢成为学术研究炙手可热的话题。作为互联网时代发展的新趋势，元宇宙虚拟社会具有沉浸式体验、强社交性、全息生存、自由创造和经济体系等显著特征。然而，数字身份、数字资产以及垄断与不公平竞争等元宇宙虚拟社会所引发的多种问题，逐渐衍生出了一系列的法律风险，法律界为了保证元宇宙虚拟社会的有序发展，需要快速应对，有必要及时回应风险需求，制定切实可行的对策，实现对元宇宙虚拟社会的有效治理。

Abstract: With the increasing maturity of blockchain, artificial intelligence and augmented reality technologies, digital existence has gradually become a new mode of human life, and the “metaverse” has slowly become a hot topic for academic research. As a new trend in the Internet era, the metaverse virtual society features immersive experience, strong socialization, holographic survival, free creation and economic system. However, digital identity, digital assets, monopoly and unfair competition, and other problems caused by the metaverse virtual society have gradually given rise to a series of legal risks. The legal profession needs to respond quickly to ensure the orderly development of the metaverse virtual society, and it is necessary to respond to the risk demand in a timely manner and formulate practical countermeasures to achieve effective governance of the metaverse virtual society.
