个人信息与隐私的对比研究和法律冲突解决路径探索

Comparative Study of Personal Information and Privacy and Exploration of Legal Conflict Resolution

摘要: 随着《个人信息保护法》的颁布与实施，我国个人信息保护制度逐步确立并得以完善，而个人信息与隐私的交叉部分——私密信息的法律适用问题仍是一个存在争议的话题。以此为背景，从个人信息与隐私的概念差异始发，依托实证研究重点分析个人信息的保护状况，比较个人信息和隐私的保护方式，在个人信息与隐私的对比研究的基础上对私密信息的法律适用问题进行分析，提出通过法律解释的方法解决私密信息的法律适用冲突问题的主张。

Abstract: With the promulgation and implementation of the Personal Information Protection Law, China’s personal information protection system has gradually been established and improved. However, the legal application of private information, which is the intersection of personal information and privacy, remains a controversial topic. Based on this background, starting from the concept difference between personal information and privacy, relying on empirical research, this paper mainly analyzes the protection situation of personal information, compares the protection methods of personal information and privacy, analyzes the legal application of private information on the basis of the comparative study of personal information and privacy, and puts forward the idea of solving the conflict of legal application of private information through legal interpretation.
