浅议《唐律疏议》中的婚姻法律制度

A Brief Discussion on the Legal System of Marriage in the Tang Code

摘要: 唐律是中国古代法典的代表作之一，其相关法律条文较为完备，其中的婚姻制度亦有很大的研究价值。本文主要通过对唐代婚姻缔结的基本原则、婚姻成立和解除婚姻的相关条件等内容进行探讨，发现唐代婚姻法不仅对于提高妇女地位、稳定家庭关系、维护社会秩序以及对唐朝的繁荣发展起到一定的积极作用，而且在内容上具有时代特色，对后代各朝婚姻立法的典范，深刻影响了后世。迄今为止，唐代婚姻法的部分法律规定对我国目前的婚姻立法也有着一定的借鉴意义，可以更好地完善和实施我国的婚姻法律制度。

Abstract: The Tang Code is one of the representative works of the ancient Chinese legal code, and its related legal provisions are relatively complete. The marriage system among them is also of great research value. This paper mainly discusses the basic principles of marriage in the Tang Dynasty and the relevant conditions for the establishment and dissolution of marriage. It is found that the marriage law of the Tang Dynasty not only plays a positive role in improving women’s status, stabilizing family relations, maintaining social order and the prosperity and development of the Tang Dynasty, but also has the characteristics of the times in content. It has had a profound impact on later generations. So far, some legal provisions of the Marriage Law of the Tang Dynasty have certain reference significance for the current marriage legislation, which can better improve and implement the marriage legal system in China.
