The Improvement of the Infringement Liability System for Spouses in Marriage

摘要: 在中国立法史上具有里程碑意义的《民法典》中，婚姻家庭独立成编，可见得婚姻家庭在人们生活中的重要性。但现实生活中屡见不鲜的婚内侵权行为，《民法典》并无对其进行相关规定。法律只规定离异的损失赔偿，这导致很多不肯离异的受害人求助无门。立法上的空白不仅使得婚内被侵权人的合法权益无法得到有效保护，同时也不利于家庭与社会的和谐。本文运用比较研究法和案例分析法等研究方法，展现当前司法审判在婚内侵权方面的现状，论证建立婚内侵权制度的必要性和可行性，并与国外有关立法进行比较与借鉴，提出将精神损害赔偿、非常财产制和债权凭证等内容纳入婚内侵权责任的救济手段中，为婚内被侵权人依法维护权益提供渠道。

Abstract: The Civil Code represents a significant milestone in China’s legislative history, with an independent chapter dedicated to marriage and family, underscoring their importance in people’s lives. However, despite this recognition, there are frequent cases of infringement within marriages that are not addressed by the Civil Code. While the law provides compensation for losses in divorce, it fails to provide provisions for victims unwilling to divorce to seek help. This legislative gap not only hinders the protection of legitimate rights and interests of victims but also affects the harmony between families and society. To fill this gap, this paper utilizes comparative research methods and case analysis to demonstrate the current state of judicial trials regarding infringement within marriage, argue for the necessity and feasibility of establishing a system for infringement within marriage, and draw from relevant foreign legislation. The proposed system includes remedies such as compensation for mental damage, non-property systems, and debt certificates for liability for infringement within marriage, providing channels for victims of infringement within marriage to maintain their rights and interests in accordance with the law.
