网络暴力入刑的可行性分析

Analysis of the Feasibility of Criminalizing Online Violence

摘要: 网络暴力犯罪是在虚拟世界中通过恶性言论方式对被害人的心理、人格、名誉造成侵害的犯罪行为。网络普及、经济形态转型和技术发展在一定程度上促进网络暴力的猖獗，呈现出侵害客体复杂、危害性大、参与者众多、形成网络黑产等新特点。本文旨在分析网络暴力行为入刑的可行性，从刑法理论、立法基础和入刑必要性三个角度论证该行为具有刑事可罚性，予以刑事制裁的现实之需契合社会公众的诉求。具体的刑罚设置上可设立专门罪名，划定立案定罪的判断标准、完善刑法配套体系三方面入手，推动刑法体系的完善，保证法治社会的良好运行。

Abstract: Online violent crime is a crime that harms the victim’s psychology, personality and reputation through vicious speech in the virtual world. Internet popularization, economic transformation and technological development have accelerated the rampant online violence, showing new characteristics such as complex infringement objects, great harm, large number of participants, and the formation of online black products. This paper aims to analyze the feasibility of criminalizing online violence, and demonstrate that the act is criminally punishable from the perspectives of criminal law theory and legislative foundation, and the practical need for criminal punishment is in line with the demands of the public. Specific criminal punishments may be set up for special crimes, delineating the judgment standards for filing cases and convictions, and improving the supporting criminal law system, so as to promote the improvement of the criminal law system and ensure the good operation of a society ruled by law.
