浅析虐待动物的行政救济

An Overview of Administrative Remedies for Animal Cruelty

摘要: 虐待动物事件最近频频出现在大众的视野，2023年5月曝光的某知名博主“虐猫事件”引起大众的强烈谴责。随着经济快速发展，人们养宠物的数量不断攀升，许多人将自己的宠物视为精神支柱，但是有些人却对自己的动物任意践踏；流浪动物被虐待、做实验、售卖等等。此种现象无论是出于人道主义关怀或者现代化文明国家的发展都是一种不文明的表现。由于我国对于动物的法律保护力度不足，大众对于这类现象除了从道德层面进行谴责以外，并无切实的惩治办法。目前，学界对于虐待动物的法律保护方式看法不一，虐待动物是否纳入刑法保护还存在诸多争议，匆忙出台专门的部门法是不现实的做法。因此作为过渡阶段，可以采取行政救济的方式对虐待动物的行为进行规制。本文将从虐待动物的定义、保护动物的正当性、我国动物保护的立法现状、国外立法现状等方面对虐待动物的问题进行分析并提出相应的建议。

Abstract: Animal abuse incidents have frequently appeared in the public recently. The “cat abuse incident” by a well-known blogger exposed in May 2023 has aroused strong condemnation from the public. With the rapid development of the economy, the number of pet owners is constantly increasing. Many people view their pets as spiritual pillars, but some people trample on their animals at will; Stray animals are abused, experimented with, sold, and so on. This phenomenon is a manifestation of uncivilization, whether it is due to humanitarian care or the development of modern civilized countries. Due to the insufficient legal protection of animals in our country, the public has no practical punishment for such phenomena other than condemning them from a moral perspective. At present, the academic community has different opinions on the legal protection methods for animal abuse, and there are still many controversies on whether animal abuse should be included in criminal law protection. It is unrealistic to hastily introduce specialized departmental laws. Therefore, as a transitional stage, administrative remedies can be taken to regulate animal abuse. This article will analyze the issue of animal abuse from the definition of animal abuse, the legitimacy of animal protection, the current legislative status of animal protection in China, and the current legislative status in foreign countries, and provide corresponding suggestions.
