购置款抵押权适用问题研究

摘要: 《民法典》第416条,动产抵押担保的主债权是抵押物的价款,标的物交付后十日内办理抵押登记的,该抵押权人优先于抵押物买受人的其他担保物权人受偿,但是留置权人除外。我国正式引入“超级优先权”制度,规定在抵押权项下,购置款抵押权破除在先担保权的影响,拥有“登记在后,效力优先”的特殊顺位规则。购置款抵押权历史源远流长,单一条文难囊括所有制度,本文试图明晰制度的适用。
Abstract: Article 416 of the Civil Code stipulates that the main claim secured by a mortgage on movable property is the price of the mortgage, and if the mortgage is registered within ten days after the delivery of the subject property, the mortgagee shall be paid in priority to other security rights of the buyer of the mortgage, except for the lien holder. China formally introduces the “superpriority” system, which provides that under a mortgage, purchase mortgage has a special subordination rule of “registration after effectiveness”, which eliminates the effect of prior security rights. The history of purchase mortgage is so long that it is difficult to encompass all systems in a single article, and this article attempts to clarify the application of the system.
