摘要: 近年来，区块链技术已成为互联网领域最热门的尖端技术，与科技领域和金融领域的研究不同，刑事法学对区块链研究的价值在于风险识别，以便建立有效的风险应对机制。区块链本身是一种中立性技术，但不法分子以获取非法利益为目的，通过区块链进行违法犯罪活动，对我国的社会、经济发展造成了巨大的危害。基于区块链刑事犯罪现状，通过评析区块链场景中涉及的刑事风险，可以提出应对区块链领域刑事风险的具体措施。

Abstract: In recent years, blockchain technology has become the hottest cutting-edge technology in the Internet field, unlike the research in the field of science and technology and finance, the value of criminal law to blockchain research lies in risk identification in order to establish an effective risk response mechanism. Blockchain itself is a neutral technology, but criminals carry out illegal and criminal activities through blockchain for the purpose of obtaining illegal benefits, which has caused great harm to China’s social and economic development. Based on the current situation of blockchain criminal offenses, by evaluating the criminal risks involved in blockchain scenarios, specific measures to deal with criminal risks in the blockchain field can be proposed.
