On the Mechanism of Data Rights Protection

摘要: 随着数字科技的不断发展，我们正在步入数字社会。整个物理世界正在不断被数字化所结构，数字革命改变了原有的社会生活方式和生产方式。随着数字社会的到来，人们可以在数字世界完成社交、学习、工作等，数据的万物互联，带给了人们全新的体验。数字科技与人们的生活密切联系，给人们带来便利的同时，也给人们的数据权利保护带来了新问题。数字化不平等与歧视、数据隐私泄露、数字化暴力问题都在揭示着新时代的数据权利保护遭遇到挑战，需要一种全新的权利保护方式来应对。在此背景下，完善对数据权利理论的分析，探索数据权利的多元保障策略无疑具有重要意义。

Abstract: With the continuous development of digital technology, we are entering a digital society. The whole physical world is constantly being structured by digitalization, and the digital revolution has changed the original social lifestyle and production mode. With the advent of digital society, people can complete social, learning, work and so on in the digital world, and the Internet of everything with data has brought people a new experience. Digital technology is closely connected with people’s life, which brings convenience to people, but also brings new problems to people’s data rights protection. The problems of digital inequality and discrimination, data privacy disclosure, and digital violence all reveal that the protection of data rights in the new era has encountered challenges, and a new way of right protection is needed to deal with them. In this context, it is of great significance to improve the analysis of data rights theory and explore the multiple protection strategies of data rights.
