类型化视角下二创短视频合理使用的判定

Determination of Fair Use of Re-Creation Short Video from the Perspective of Categorization

摘要: 二创短视频使用他人作品是否构成合理使用这对于保障著作权人的利益和促进短视频行业的发展都有着重要意义。针对短视频行业目前面临的侵权问题，首先需要厘清短视频合理使用的判定标准，根据短视频的内容可以将其划分为切条搬运型、影视解说型、影视评论型和戏仿恶搞型等几种类型，本文试图通过类型化的视角来对二创短视频的合理使用的判定提出可以普遍适用的标准。

Abstract: Whether the use of other people’s works constitutes fair use is of great significance for protecting the interests of copyright owners and promoting the development of the short video industry. In view of the current infringement problems faced by the short video industry, it is necessary to clarify the judgment criteria for the fair use of short videos. According to the content of short videos, they can be divided into several types, such as Cutting and Transporting Type, Film and Television Narration Type, Film and Television Commentary Type and Parody Type Short Video. This paper tries to put forward a universally applicable standard for the judgment of the fair use of recreation short videos from the perspective of categorization.
