浅析亚运会元素商品化权保护

Analysis of the Protection of the Right to Merchandise the Elements of the Asian Games

摘要: 第19届亚运会在杭州的举办和召开对于浙江省乃至全国而言都是一个盛事。随着亚运会的举办，亚运会的各种知识产权元素的保护就显得十分重要，对于上述知识产品的保护不仅仅需要知识产权权利人以高度的权利意识进行维护，同时也需要司法与行政执法领域“双管齐下”共同打造对其保护的藩篱。亚运会所孕育的知识产权元素特色鲜明，既涉及到知识产权专门法的保护，也落入到反不正当竞争法的领域之中。浙江作为打造知识产权强省的排头兵，应紧抓机遇，充分整合司法与行政资源来应对知识产权的保护工作。这不仅仅符合了《浙江省知识产权“十四五”规划》有关精神，而且也是对《知识产权强国建设纲要(2021~2035年)》有关规划的生动诠释。在对亚运会各元素保护的过程中一些问题较为突出，应在认识到问题的基础上提出相关对策加以解决，以推动亚运会的有序进展。

Abstract: The 19th Asian Games held in Hangzhou is an important event for Zhejiang Province and the whole country. A two-pronged approach is needed to build a fence for the protection of these intellectual products. The distinctive intellectual property elements bred by the Asian Games involve both the protection of specialized intellectual property laws and the field of anti-unfair competition laws. As a leader in building a strong IPR province, Zhejiang should seize the opportunity to fully integrate judicial and administrative resources to deal with the protection of IPR. This is not only in line with the spirit of the 14th Five-Year Plan for Intellectual Property in Zhejiang Province, but also a vivid interpretation of the plan of the Outline for the Construction of a Strong Intellectual Property State (2021~2035). In the process of protecting the elements of the Asian Games, some problems are more prominent, and we should put forward relevant countermeasures to solve them on the basis of recognizing the problems, so as to promote the orderly progress of the Asian Games.
