企业刑事合规的刑行衔接问题初探

A Preliminary Study on the Criminal-Execution Interface of Corporate Criminal Compliance

摘要: 检察机关在开展刑事合规过程中，需要发挥刑行衔接的作用，构建一套与行政机关配合的制度。在实践中，刑事合规制度中的刑行衔接还存在诸多争议，既包括刑行衔接的案件移送的共性问题，也包括合规考察、处理结果以及合规不起诉后的监管等个性问题。为了解决企业刑事合规的刑行衔接问题，需要从刑事合规的整体发展流程入手，明确检察机关在刑事合规中的主导作用，在顶层设计上规范各地检察机关决定适用刑事合规的标准，厘清各个阶段检察机关与行政机关的职责以及配合方式，从而发挥出刑事合规的应有功效。

Abstract: In the process of criminal compliance, procuratorial organs need to play the role of criminal-executive interface and construct a system to cooperate with administrative organs. In practice, there are still many controversies in the criminal-executive interface in the criminal compliance system, including both the common issues of the transfer of cases in the criminal-executive interface and the individual issues of compliance inspection, processing results and supervision after nonindictment of compliance. In order to solve the problem of criminal-execution interface of corporate criminal compliance, it is necessary to start from the overall development process of criminal compliance, clarify the leading role of procuratorial organs in criminal compliance, standardize the criteria for deciding on the application of criminal compliance by procuratorial organs around the world in the top-level design, and clarify the responsibilities of procuratorial organs and administrative organs at each stage and the way of cooperation, so as to bring into play the proper efficacy of criminal compliance.
