摘要: 近年来，美国通过频繁使用出口管制以及经济制裁等手段来加大对中国企业的出口贸易限制以达成自身国家安全和经济利益目标。对中国企业在国际科技交流、对外贸易合作以及全球供应链体系的构建等方面都产生了重大影响。有鉴于此，中国企业在对外出口贸易过程中会面临各种合规困境，在复杂多变的形势下，美国对华经济制裁趋势持续加强以及严苛的出口管制新规，中国政府也应更加重视出口管制领域的立法与执法以及积极完善反外国制裁法律体系，中国企业同时需要完善企业合规制度，建立企业合规管理体系。本文将分析美国出口管制以及经济制裁下中国企业合规困境的成因以及如何应对这些困境为中国企业在出口管制及经济制裁的双重困境下的合规出路提供对策建议。

Abstract: In recent years, The United States, through frequent use of export control and economic sanctions, has increased export trade restrictions on Chinese enterprises to achieve its own national security and economic interests. It has a significant impact on Chinese enterprises in international scientific and technological exchanges, foreign trade cooperation and the construction of the global supply chain system. In view of this, Chinese enterprises will face various compliance dilemmas in the process of foreign export trade. In the complex and changing situation, the United States continues to strengthen the trend of economic sanctions against China and strict new export control regulations, the Chinese government should also pay more attention to the legislation and law enforcement in the field of export control and actively improve the legal system of anti-foreign sanctions. Meanwhile, Chinese enterprises need to improve the corporate compliance system and establish enterprise compliance management system. This paper will analyze the causes of compliance dilemmas of Chinese enterprises under US export control and economic sanctions and how to deal with these dilemmas to provide countermeasures and suggestions for Chinese enterprises to comply with the dual dilemmas of export control and economic sanctions.
