浅析法律与道德的冲突与融合

A Brief Analysis of the Conflict and Integration of Law and Morality

摘要: “法安天下，德润人心”，法律与道德的关系从古至今都是一对既相互融合又相互冲突的概念，无论是从西方的自然法学派和实证主义法学派还是中国古代的儒家和法家，都表现出了两者在起规范作用的过程中会出现相互协调又相互矛盾的情况。而法律和道德同为规范社会的一种手段，在实施的过程中通常会出现矛盾，我们究竟应当怎么去处理法律与道德的矛盾，也成为了摆在我们面前的一个难题，本文旨在通过对历史上法律与道德的关系的梳理，总结得出怎样做到法律与道德最大限度的平衡。

Abstract: “Law enforces the world, and virtue moistens the hearts of men”. The relationship between law and morality has been a pair of concepts that are both integrated and conflicting from ancient times to the present, whether from the Western natural law school and the positivist legal school or the ancient Chinese Confucianism and legalism, both show that the two will coordinate and contradict each other in the process of playing a normative role. Law and morality are both a means of regulating society, there are usually contradictions in the process of implementation, how should we deal with the contradiction between law and morality, has also become a difficult problem in front of us, this article aims to sort out the relationship between law and morality in history, summarize how to achieve the maximum balance between law and morality.
