RTAs视阈下数字贸易壁垒的规制与协调

Regulation and Coordination of Digital Trade Barriers from the Perspective of RTAs

摘要: 经济全球化的发展，使得各国间贸易增多，RTAs作为一种具有法律效力、贸易自由化程度较高的区域经济合作形式，为各国与各地区之间消除数字贸易壁垒、沟通数字贸易规则提供了良性渠道。然而，大量缔结的RTAs加剧了国内法与国际法规制间的冲突，其碎片化、冲突化的特征也构成了现实适用难题。为此，本文由RTAs规制数字贸易壁垒的相关概述出发，具体分析了RTAs数字贸易规则的运行现状，对比CPTPP、RCEP主要数字贸易规则，从而为形成更符合我国基本国情的RTAs范式提出建议，应当明确规制立场，在完善现有国内数字贸易规制及监管体系的前提下，进一步加强与RTAs规制的融合与有效衔接。

Abstract: With the development of economic globalization, the trade between countries increases. As a form of regional economic cooperation with legal effect and higher degree of trade liberalization, RTAs provides a benign channel for eliminating digital trade barriers and communicating digital trade rules between countries and regions. However, a large number of concluded RTAs intensifies the conflict between domestic law and international law, and its fragmented and controversial characteristics also constitute a practical application problem. Therefore, this paper starts from the relevant concepts of RTAs regulation of digital trade barriers, and specifically analyzes the operation status of RTAs digital trade rules. By comparing the main digital trade rules of CPTPP and RCEP, it is proposed to form a RTAs paradigm which is more consistent with the basic conditions of China. We should make a clear regulation stance, and improve the existing domestic digital trade regulations and legal system, further strengthening the integration and effective cohesion with RTAs regulation.
