夫妻忠诚协议的法理分析
Jurisprudence Analysis of Spousal Fidelity Agreement
摘要: 夫妻忠诚协议作为夫妻忠实义务的具体化表现形式，在实践中广为使用。但是，围绕夫妻忠诚协议的法律性质、法律效力问题始终缺乏定论。夫妻忠诚协议以配偶权与夫妻忠实义务为基础，其所具备的法律性质、法律效力尚存争议，夫妻忠诚协议的身份性质与财产性质均不可被忽视，应对其效力采取区分视角看待，肯定夫妻忠诚协议在婚姻家庭领域的正面效果。
Abstract:
As a concrete manifestation of husband and wife’s loyalty obligation, spousal fidelity agreement is widely used in practice. However, the legal nature and legal effect of the spousal fidelity agreement have always been inconclusive. The spousal fidelity agreement is based on the spouse’s rights and marital loyalty obligations, and its legal nature and legal effect are still controversial. The identity and property nature of the spousal fidelity agreement can not be ignored. We should treat its effectiveness from a different perspective and affirm its positive effect in the field of marriage and family.
