摘要: 共同犯罪人的身份不同对保险诈骗案件定性有重要影响。在内外勾结案件中，内部人员的身份和其在共同犯罪中的地位可能会使保险诈骗行为最终被定性为职务侵占或贪污行为。内外部人员均为主犯时，应当想象竞合择一重罪处罚。内外部人员有主从犯区分时，应当依据司法实践中采取的主犯决定说定罪量刑。对于不涉及内外勾结的保险诈骗共同犯罪案件，则应根据各行为人身份及其在共同犯罪中的地位和作用，依据主犯决定说定罪量刑。

Abstract: The different identities of co-criminals have an important impact on the characterization of insurance fraud cases. In the case of internal and external collusion, the identity of the insider and the position of the insider in the joint crime may make the insurance fraud be characterized as the embezzlement. When both internal and external persons are the principal offenders, one should imagine competing and co-opting a felony punishment. When internal and external personnel have the distinction between principal and subordinate offenders, they should be convicted and punished according to the decision of principal offender adopted in judicial practice. For the insurance fraud joint crime case that does not involve internal and external collusion, it should be based on the identity of each perpetrator and their status and role in the joint crime, according to the decision of the principal offender.
