On the Crime of Throwing Objects at High Altitude

摘要: 高空抛物是随着经济社会的发展而衍生出来的新问题，高空抛物被视为“悬在城市上方的痛”，严重危及人民群众的生命安全，为保障人民群众“头顶上的安全”，我国已将高空抛物行为纳入刑事规制范畴，《刑法修正案(十一)》增设高空抛物罪。高空抛物罪作为一个新增罪名，其增设有预防、震慑高空抛物行为，维护社会管理秩序等多方面的积极意义，但在具体的司法实践活动当中，对高空抛物行为的判定应落实罪刑法定原则的要求，结合构成要件的该当性，根据不同情形下的高空抛物行为进行定罪量刑，本文将对高空抛物罪的设立必要性及罪名适用等问题进行阐释。

Abstract: High-altitude parabolic is a new problem derived from the development of economy and society. High-altitude parabolic is regarded as “the pain hanging above the city”, which seriously endangers the life safety of the people. In order to ensure the safety of the people’s “overhead”, China has incorporated high-altitude parabolic behavior into the scope of criminal regulation, and the “Criminal Law Amendment (11)” has added the crime of high-altitude parabolic. As a new crime, the crime of throwing objects at high altitude has many positive significances, such as preventing and deterring throwing objects at high altitude, maintaining social management order and so on. However, in the specific judicial practice activities, the judgment of the high-altitude parabolic behavior should implement the requirements of the principle of legality, combined with the appropriateness of the constitutive elements, according to the conviction and sentencing of the high-altitude parabolic behavior under different circumstances. This article will explain the necessity of the establishment of the high-altitude parabolic crime and the application of the crime.
