农村宅基地使用权流转法律规制研究
Research on the Legal Regulation of the Circulation of Rural Homestead Use Rights
摘要: 在乡村振兴战略中,农村宅基地使用权的经济价值日益提升,探索农村宅基地使用权流转机制对中国农村土地改革具有重要意义。我国目前并未对宅基地使用权流转进行规定,将严重阻碍我国农村地区的宅基地资源开发和利用。由于不够完善的宅基地使用权流转法律体系、难以确认产权的宅基地、不统一的地价评估标准等一些问题,造成了宅基地使用权流转存在多重障碍。现实中宅基地使用权隐形流转现象又极为普遍,因没有合理的监管机构和平台,导致宅基地纠纷不断,影响社会的稳定和发展。在落实乡村振兴战略背景下,确保宅基地使用权的社会保障功能的实现,完善相关的法律法规,建立明确的地价评估系统,为流转主体提供合法的交易平台,监管交易过程。通过宅基地使用权流转实现集体、转让人、受让人的合作共赢,促进乡村经济的发展。同时,目前关于宅基地使用权流转的法律法规不健全,使得宅基地产权难以确认,宅基地地价难以评估,给农村宅基地使用权流转造成障碍。
Abstract:
The economic value of rural homestead use rights is increasing in the rural revitalization strategy, and exploring the circulation mechanism of rural homestead use rights is of great significance to China’s rural land reform. However, China currently does not regulate the circulation of homestead use rights, which will seriously hinder the development and utilization of homestead resources in rural areas of China. Due to some problems such as the imperfect legal system for the circulation of the right to use the homestead, the homestead where it is difficult to confirm the property right, and the non-uniform land price assessment standards, there are multiple obstacles to the circulation of the right to use the homestead. In reality, the phenomenon of invisible circulation of home-stead use rights is extremely common, and due to the lack of reasonable regulatory bodies and platforms, homestead disputes continue to occur, affecting social stability and development. In the context of implementing the rural revitalization strategy, ensure the realization of the social security function of the right to use the homestead, improve relevant laws and regulations, establish a clear land price assessment system, provide a legal trading platform for circulation entities, and supervise the transaction process. Through the circulation of the right to use the homestead, the collective, the transferor and the transferee will achieve win-win cooperation and promote the development of the rural economy. At the same time, the current unsound laws and regulations on the circulation of the right to use homesteads make it difficult to confirm the property rights of home-steads, and it is difficult to assess the land price of homesteads, which has caused obstacles to the circulation of the right to use rural homesteads.
