个人信息保护的公私法适用路径研究

摘要: 个人信息的私法保护指通过积极确权模式和行为规范模式进行民法上的保护，其注重个人信息的私益性，从不同维度来看具备相应的合理性，同时由于其局限性也带来了人们对私法保护模式的重新审视。对个人信息的公法保护虽然在一定层面上弥补了私法保护的漏洞，但由于立法执法及监管的不完善，也不可避免地呈现出些许瑕疵。通过分析个人信息的公私法保护局限性及探究信息划分机制和责任承担机制，接橥个人信息公私法保护各自的适用范围与适用机制，厘清公私法保护的界限，以便构建个人信息法律保护体系。

Abstract: The private law protection of personal information refers to the civil law protection through the positive confirmation mode and the behavior norm model, which pays attention to the private interests of personal information and has corresponding rationality from different dimensions, and at the same time, due to its limitations, it has also brought about a re-examination of the private law protection model. Although the public law protection of personal information fills the loopholes in the protection of private law to a certain extent, it inevitably presents some defects due to the imperfection of legislative enforcement and supervision. By analyzing the limitations of public and private law protection of personal information and exploring the information division mechanism and responsibility bearing mechanism, we will clarify the scope of application and application mechanism of personal information public and private law protection, and clarify the boundaries of public and private law protection, so as to build a personal information legal protection system.
